Agencies and studios: what to do when you are accused of using AI
A client is questioning deliverables, or invoking an AI warranty clause in the master services agreement.
- What is at stake
- The account, plus every other client the story reaches. This is the highest-value dispute on this list.
- Your evidence position
- You control the process end to end: briefs, drafts, assigned writers, internal review. That means you can produce evidence per deliverable rather than per accusation, and you can change the contract going forward.
- Do this first
- Separate the two questions. Whether the work is good is a scope conversation. Whether a detector flagged it is a tooling question that does not belong in a payment decision.
- The trap
- Letting one deliverable become a precedent for the whole book of work. Fix the clause across every contract.

Agencies and studio disputes usually turn on the same few things: what a detector actually claims about its own accuracy, which pieces of evidence survive scrutiny, and whether a contract put the risk on you. The pages below cover each.
